Learnership Agreement Guidlines | Construction Education and Training Authority

 
1.
It is legal requirement that, prior to entering a learner onto a learnership, a Learnership Agreement be signed between the learner, the employer and the training provider.
2.
All information required in the Agreement must be completed in black ink.
3.
Parties concerned must initial each page and sign the last page of the Agreement.
4.
If the learner is a minor (an unmarried person under the age of 21) the learner's parent or guardian must sign the Agreement.
5.
The employer party to the Agreement must fall within the scope of coverage of the CETA.
6.
The Learnership Agreement must be concluded before the start of the learnership.
7.
Two original and identical copies of the completed Learnership Agreement must be submitted to the CETA for purposes of registering the Agreement.
8.
Copies of the Learnership Agreement must be provided to the learner and the training provider.
9.
The Managing Director of the company, or an employee of the company duly authorised by the company, must sign the Agreement on behalf of the employer party.
10.
Where the company will be the main/lead training provider, the Manager responsible for the training must be duly authorised by the company to sign as the provider party to the Agreement.
11.
The CETA will inform the company within 30 days of receipt of the Agreement of the registration/non-registration of the Learnership Agreement.
12.
In the case of an unemployed or pre-employed learner, a copy of the contract of employment must acompany the Learnership Agreement submitted to CETA.
13.
The Department of Labour registration number of the Learnership is available from the CETA offices.
14.
Please ensure that there are witnesses to the Agreement, and that they sign the space provided at the end of the document.
15.
The SIC code (Sections 4.10 and 5.10) refers to Standard Industrial classification code, which is available from CETA.
16.
The SARS code (Sections 4.10 and 5.10) is the Levy registration number of the company.
17.
The SAQA code (Section 5.10) is the ETQA accreditation number, as issued by an ETQA.
